Welcome to YALD Store. This online store and related website are operated by YALD, Inc., a nonprofit organization doing business as YALD Store (“YALD,” “we,” “us,” or “our”).

These Terms of Service govern your access to and use of the YALD Store website, products, services, checkout, communications, and related features (collectively, the “Services”).

By accessing, browsing, or using the Services, or by placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the Services.

1. Eligibility and Use of the Services

You must be legally able to enter into a binding agreement to place an order through the Services. If you are under the age of majority where you live, a parent or legal guardian must make or authorize the purchase.

You agree to provide accurate, current, and complete information when using the Services, including your name, email address, shipping address, billing information, and payment details.

You may not use the Services for unlawful, fraudulent, abusive, or unauthorized purposes.

2. Products and Availability

YALD Store offers apparel, accessories, and original community designs. Many products are made to order through our fulfillment partner, Printful.

Product images, colors, sizing, descriptions, and availability are provided for general information. Colors and appearance may vary depending on your device, monitor, printing process, product variant, and production availability.

We make reasonable efforts to keep product information accurate, but we do not guarantee that every description, image, price, availability notice, or other store content is error-free, complete, or current.

We may correct errors, update information, change pricing, limit quantities, discontinue products, or cancel orders when necessary, including when a product listing contains an error.

3. Orders and Acceptance

Your order is an offer to purchase products from YALD Store. Receipt of an order confirmation does not mean that we have accepted the order.

We may accept, decline, limit, or cancel an order for reasons including product availability, suspected fraud, inaccurate pricing, fulfillment limitations, incorrect customer information, or a violation of these Terms.

If we cancel an order after payment has been processed, we will issue a refund for the canceled item or order when appropriate.

4. Prices, Taxes, and Payment

Prices are listed in U.S. dollars unless otherwise stated. Applicable taxes, if any, are calculated at checkout.

Payment must be authorized before an order is fulfilled. You are responsible for providing accurate payment and billing information.

We may change prices at any time. A price change does not affect an order that has already been accepted and paid, except where a pricing error occurred.

5. Shipping and Delivery

Shipping, fulfillment, delivery estimates, address requirements, tracking, and related matters are governed by our Shipping Policy.

Most YALD Store products are made to order. Production and delivery times may vary based on the product, fulfillment location, destination, carrier, weather, holidays, supply availability, and other circumstances outside of YALD’s control.

You are responsible for providing a complete and accurate shipping address. YALD is not responsible for delays, failed delivery, or returned shipments caused by an incorrect or incomplete address provided by the customer.

6. Returns, Refunds, Exchanges, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by our Return and Refund Policy.

Because many products are made to order, we generally do not accept returns or exchanges for change of mind or incorrect size selection. We will review claims involving damaged, defective, misprinted, incorrect, or fulfillment-error items in accordance with our Return and Refund Policy.

7. YALD Mission and Use of Proceeds

YALD Store supports the work of YALD, Inc., including youth programs, leadership development, mentorship, training, uniforms, scholarships, and community events.

Statements that purchases “support YALD” describe the store’s connection to YALD’s mission and operations. They do not mean that each purchase is a tax-deductible charitable contribution. Customers should not treat merchandise purchases as charitable donations unless YALD specifically provides written documentation stating otherwise.

8. Intellectual Property

The YALD name, logo, designs, photographs, graphics, text, branding, website content, and other materials displayed through the Services are owned by or licensed to YALD, Inc. and are protected by applicable intellectual-property laws.

You may not reproduce, modify, distribute, display, sell, license, or use YALD Store content, branding, or designs without prior written permission from YALD, Inc.

The purchase of a product does not transfer ownership of YALD intellectual-property rights.

9. Third-Party Services

The Services may rely on third-party platforms and providers, including Shopify, Printful, payment processors, shipping carriers, Shop, and social-media platforms.

We are not responsible for third-party services, websites, policies, outages, delays, or actions outside our reasonable control. Your use of third-party services may be subject to their own terms and privacy policies.

10. Disclaimers

The Services and products are provided on an “as available” basis, except where law requires otherwise.

To the fullest extent permitted by law, YALD disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms is intended to limit rights or warranties that cannot legally be excluded.

11. Limitation of Liability

To the fullest extent permitted by law, YALD, Inc., YALD Store, its officers, directors, employees, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services, products, or these Terms.

To the fullest extent permitted by law, YALD’s total liability for a claim related to an order or the Services will not exceed the amount you paid to YALD for the product or service giving rise to that claim.

Nothing in these Terms limits liability where it cannot legally be limited.

12. Indemnification

You agree to indemnify and hold harmless YALD, Inc., YALD Store, and their officers, directors, employees, volunteers, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from your violation of these Terms, your misuse of the Services, or your violation of another person’s rights.

13. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute arising from or related to these Terms or the Services will be handled in the state or federal courts located in New York County, New York, unless applicable law requires another venue.

Nothing in this section limits consumer rights that cannot legally be waived.

14. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on the Services with a revised “Last updated” date. Continued use of the Services after an update means you accept the updated Terms, to the extent permitted by law.
